*Brief of the Case*
It came to light that the complainant B. Narsingha Patra’s mother had a piece of land in Bhabinipur mouza. His mother had executed a power of attorney to Rajib Kumar Tripathi s/o Pratap Chandra Tripathi of Brajanagar 1st lane Lochapada to sell the land on *22.03.2010* . Unfortunately, his mother B Kasturi Patra expired on *23.06.2010* , only three months after executing the power of attorney.
At the time of execution of the power of attorney, the land in question was Khata No 129, Plot No 384 (0.377 Decimal) and Plot No 1041 (0.454 Decimal).
Before executing the power of attorney, the accused had agreed to give ₹10 Lakhs per Bharana (Approx. 200 Decimal). However, due to the death of the mother, the power of attorney automatically became invalid.
Despite knowing that the power of attorney had become invalid after the death of the complainant’s mother, the accused dishonestly and deceitfully sold the land using the invalid power of attorney. When the complainant later wished to sell his land, he came to know that the accused had already sold the entire land on the basis of the invalid power of attorney without re-executing any fresh power of attorney with the complainant.
The accused knowingly sold the property for wrongful gain even after the power of attorney had lapsed.
A raid was conducted and the accused was apprehended. On examination, he confessed his guilt and cited no defence. He was arrested today i.e. on 16.05.2026.
He has been forwarded to the Honourable Court of JMFC, Berhampur today i.e. 16.05.2026.
