Rule 37 Mines and Minerals Act: Prabhakaran-Ahluwalia Brothers proves mettle again

NEW DELHI/JODA/BARBIL/BHUBANESWAR: Call it B Prabhakaran of Thriveni Earth Movers Pvt Ltd  –Ahluwalia Brothers read Kamaljit Sinngh Ahluwalia and Prashant Ahluwalia of KJS Ahluwalia Group and Kapyee Enterprises Pvt Ltd proved their mettle again with Supreme Court appointed committee of Justice (Retired) Anil R Dave and Justice (Retired) GS Singvi giving clean chit to 4 selected miners including KJSA Group, Indrani Patnaik, Sirajjuddin and Company Pvt Ltd and RP Sao Pvt Ltd, whose common contractor was B Prabhakaran.

It may be noted here that basing on several petitions; the Apex Court had on November 22, 2017 appointed a 2 members committee while the committee held hearing from February 19 to July 3, 2018. Next hearing will be held in Supreme Court on January 27, 2020.

The Committee heard allegations against KJS Ahluwalia, Kabita Agarwal Mines, MESCO Steel, Indrani Patnaik, Sirajjuddin and Company Pvt Ltd, RP Sao, Sarada Mines Pvt Ltd,Mala Roy, AMTC but KJS , Indrani, Sirajjudin, RP Sao got clean chit because of Prabhakaran’s pro-active role in both Bhubaneswar and New Delhi.

The committee has also absolved mining contractor Thriveni Earth Movers Ltd of B Prabhakaran of Salem Tamil Nadu, which had been accused by Chief Minister Naveen Patnaik’s political opponents of having usurped control of mines leased to R P Sao, Indrani Patnaik, Serajuddin and KJ S Ahluwalia. The report concluded that the lessees that had hired the Salem-based contractor had done so without ceding control of their mines.

These lessees, along with five others, were accused of violating Rule 37 of the Mineral Concession Rules, 1960 (now amended) which bars the transfer of control of a lease without prior government approval. Sarda Mines, accused by the state government of supplying subsidised ore to Jindal Steel and Power NSE -1.95 %, has also been found not violating mining rule.

“With SC appointed panel giving clean chit, both B Prabhakaran and Ahluwalia brothers would got more free hands in Odisha’s mineral rich Keonjhar and Sundargarh districts,” added an activists in Joda in Keonjhar.  Sources said, Prabhakaran used all his political and financial lobby to got clean chit.
