BHUBANESWAR: CC & EO PS CASE NO. 74, Dt.18.03.2024 U/S 420 IPC RW Sec 66(B)/65 IT Act. turned to U/S 420/381/166A/409/34 IPC RW Sec 66 C/66 (D) IT Act.
Complainant: Anupam Saha(39), IAS (8280066852) resident of Gountia, Po- Kesinga, Amath, PS- Kesingh, Dist- Kalahandi, Pin-766012 at/pr Qr. No.16, Type-A, Po-CRPF, VIP Colony, PS-Nayapalli, Bhubaneswar, Pin-751015 working as State Project Director of Odisha School Education Programme Authority.
Gist of Case:
On dtd. 18.03.2024 complainant Anupam Saha(39), IAS (8280066852) resident of Gountia, Po- Kesinga, Amath, PS- Kesinga, Dist- Kalahandi, Pin-766012 At/pr Qr. No.16, Type-A, Po-CRPF, VIP Colony, PS-Nayapalli, Bhubaneswar, Pin-751015 working as State Project Director of Odisha School Education Programme Authority appeared at PS and reported in writing to the effect that someone has leaked question papers of the Summative Assessment-II of class-1 to 8 supplied by OSEPA (Odisha School Education Programme Authority) and uploaded on one YouTube channel namely “Samir Educational” having profile URL https://www.youtube.com/@samirsahu123.
So, he reported at the PS for necessary action. Basing on the report, IIC CC & EO PS BBSR registered PS Case No.74 dtd. 18.03.2024 u/s-420 IPC / 66(B)/65 IT Act and Addl IIC Pinki Murmu took up the investigation of the case.
Investigation:
In course of the investigation, we got digital evidence, took the screenshot of the of the IP ddress and the phone number used to open the youtube channel ProAnswer, verified the place of stay and their profile and from the digital evidences collected so far, it is well established that the accused persons have committed the offence liable u/s 420/381/166A/409/34 IPC RW Sec 66 C/66 (D) IT Act.
Modus Operandi/Methodology :
The accused Jagannath Kar (29) S/o- Rajesh Kumar Kar of village Jhadanga PS-Town , Dist-Jajpur is working as an Assitant Teacher of Gopinath Jew Nodal Upper Primary School, Sridharpur PS-Town, Dist Jajpur and his wife Rutupurna Pati (27) C/o- Jagannath Kar of village Jadanga, PS-Jajpur Town, Dist-Jajpur has a YouTube channel namely ProAnswer having 25.9 K subscribers and 103 videos uploaded.
To gain YouTube subscriber, likes, share, popularity and to earn huge sum in short time from in furtherance of their common intention they planned to upload the question and answer of the Summative Assessment Test of Class 1-8 question paper on their YouTube channel prior to the schedule date of the examinations which was supposed to be in confidential and in safe custody as it is valuable security of state. So on dt. 09.03.2024 as per their plan, Jagannath Kar took the question paper on behalf of Head Mistress of Itara Primary School from the Cluster Research Centre Coordinator Gopinath Jew NUPS to his home and then Jagannath Kar and his wife Rutupurna Pati scanned the question through their mobile and on the same day and uploaded the same on their YouTube channel i.e. ProAnswer prior to examination ie.15th March 2024.
Arrest: During investigation, previously one accused namely Samir Sahu (21), S/o- Raghunath Sahu, At- Khandadeuli, PS: Rambha, Dist- Ganjam district who had YouTube channel “Samir Educational” was arrested and forwarded to the Hon’ble Court on 30.03.2024 as per FIR and all digital evidences. On further investigation it is ascertained that the question and answer paper was leaked first by the following accused persons hence they have been apprehended, and further follow up action will be taken as per law. Accused Jagannath Kar working as an Asst. Teacher of Gopinath Jew Nodal Upper Primary School, Sridharpur PS-Town, Dist Jajpur and was (public servant) along with wife Rutupurna Pati has jointly committed the crime.

Articles seized from possession of Accused:
(1) 02 Mobile handset of accused (one of husband and another of wife used for making video on Youtube
(2) One Laptop of accused
(3) 09 Nos of Answer Paper of Summative Assessment-II of class-1 to 8.
(4) 02 No Bank Passbook
